Subject: Sock Labeling Law Enacted to Require More Prominent Marking of Country of Origin Importance: High President Bush signed into law on December 3, 2004, Public Law 108-429 that will require new and prominent country of-origin labeling on socks.
The Congress passed this legislation (H.R. 1047) on November 19, 2004. The new sock labeling requirement will go into effect on or about March 3, 2006. The 15 month phase-in period was negotiated to allow for time to change packaging and to use up the old packaging stocks. The new labeling requirement contained in Section 336 (k) (1) of H.R. 1047 reads as follows: “(k) Marking of Certain Sock Products. - (1) Socks provided for in subheading 6115.92.90; 6115.93.90; 6115.99.18; 6111.20.60, and 6111.30.50 or 6111.90.50 of the Harmonized Tariff Schedule of the United States (all those socks subject to the Special China Safeguard Petition on socks) ... shall be marked as legibly, indelibly, and permanently as the nature of the article or package will permit, in such a manner as to indicate to the ultimate consumer in the United States the English name of the country of origin of the article. The marking required by this subsection shall be on the front of the package, adjacent to the size designation of the product, and shall be set forth in such a manner as to be clearly legible, conspicuous, and readily accessible to the ultimate consumer. (2) EXCEPTIONS. - Any package that contains several different types of goods and included socks (with those HTS numbers listed above) shall not be subject to the requirements of paragraph (1).
